PREFACE
Many excellent books have been written on the subject of public utilities. Most of these, because of the broad field covered, deal chiefly with decisions by courts and a limited number of general principles gleaned from reports of the Public Service Commissions. Others pertain to specific branches of the subject such as valuation, depreciation, and rate making. There seems to be a need, however, for a treatise covering the details of public utility service and the regulatory problems arising in the relations between the utilities and their customers. These relations are governed by fundamental principles based on mutual fairness. The utilities must serve without discrimination and each customer must recognize the rights of the utility and the rights of other customers. The problems arising from this relationship are constantly being met and solved by the Public Service Commissions, and it is the purpose of this volume to examine their rulings and the pronouncements of the courts to discover the results of their activities in applying such fundamental principles. Public understanding of the problems of the utilities and OD understanding by the utilities of the requirements which the Commissions may fairly insist upon should lead to a better spirit of co-operation and an improvement in public relations.
Copious citations of authorities, both court and Commission, are included. Decisions by courts on the many details of utility service are few in comparison with the rulings by Commissions. Many problems never reach the courts, which hold that they should not interfere with the administrative functions of Commissions unless an arbitrary or unlawful abuse of discretion is shown. Hence the utilities are for the most part operating under the guidance of the principles announced by these administrative bodies, and it is largely in the reports of the Commissions that we shall find the answers to everyday regulatory problems which must be solved.
