National Railroad Passenger Agreement Lot Southern Pacific & Atchison, Topeka Santa Fe

In response to a Freedom of Information Act (FOIA) request, Amtrak has supplied me with copies of its operating and financial agreements with the Santa Fe and the Southern Pacific railroads. A copy of each is enclosed. This letter, which to some extent is a follow-up on the excellent article by Bob Johnston in the January 1995 issue of TRAINS, will discuss some of the key issues relating to these agreements.
The agreements cover the operation of Amtrak trains over the tracks of the railroads and the compensation that Amtrak must pay for the railroad services and facilities which it utilizes. While many provisions in the two agreements are identical, you will note some differences in those parts which have been added or revised since April 1, 1971. My understanding is that the agreements with all the other railroads, with the exception of Conrail, are basically similar. To the extent relevant, the following discussion will refer to the Amtrak law as well as to the agreements.
