This book has been prepared by the General Chairman, under instructions from the General Grievance Committee, which action was taken the last time the General Committee was in session. The purpose of the General Committee in having this book formulated, printed, and placed in the hands of each member is to give all our members all the information possible in reference to the intent and application of our several schedule rules. Hundreds of our System Joint Reviewing Committee Decisions are in principle interpretations of the provisions of our Schedule. Many of the decisions of the General Managers' and General Superintendents' on individual grievances are in principle mutual joint agreements as to the application of our Schedule Rules to certain individual situations.
In considering the intent of various Joint Reviewing Committee decisions, the General Chairman has attempted to interpret these decisions in the manner in which he believes the Joint Reviewing Committee intended them to apply at the time the decision was rendered. These analyses of the System Joint Reviewing Committee Decisions he has designated as "Interpretations" for the reason that the decisions on which they are based arc actually interpretations of certain Schedule Rules.
In his analysis of certain General Managers' and General Superintendents' decisions, the General Chairman has attempted to interpret these decisions in the manner in which it was mutually agreed between the General Manager or General Superintendent and General Chairman that the particular Schedule Rule involved applied to that particular situation. These analyses of General Managers and General Superintendents' decisions the General Chairman has designated as "Decisions" for the reason that, while they are not interpretations of the Schedule to the extent or in the same manner as Reviewing Committee Decisions, they are decisions of the general operating officers in the territories covered by the cases. These decisions are therefore indicative of the understanding of the General Chairman and certain operating officers as to the application of certain Schedule Rules.
For convenience in considering the application of our Schedule Rules, the Schedule Rule itself is quoted, immediately followed by the interpretations and decisions applicable thereunder. In each Interpretation, reference is made to the Joint Reviewing Committee Decision or Decisions on which it is based. All Joint Reviewing Committee Decisions cited will be found in the back of this hook arranged in numerical order. In each Decision reference is made to the General Manager's or General Superintendent's decision or decisions on which it is based, which decisions are referred to as "Exhibits," each Exhibit being numbered. These numbered Exhibits will be found in numerical order, printed in the hack of this book immediately following the Joint Reviewing Committee Decisions.
Immediately following the Interpretations and Decisions under Regulation No. 8-F-I you will find a group of Interpretations and Decisions under the heading "Miscellaneous." These are Interpretations and Decisions on miscellaneous matters not specifically coming under the provisions of any particular regulation.
Where no interpretation or Decision is found immediately following a quoted regulation, such absence is due to the fact that no clear Joint Reviewing
Committee Decision or General Manager's or General Superintendent's decision has been made on that particular regulation.
Members, in making time card claims for pay which they believe are due them, should cite the particular regulation on which they are basing their claim. Local Chairmen, in presenting claims to the Superintendent, should he particular to cite the regulation on which the claim is based. In addition, they are at entire liberty to also cite the Joint Reviewing Committee Decision or General Manager's or General Superintendent's decision on which their claim is based.
Owing to the large number of engineer members who are entitled to all the information obtainable, the same as our firemen and hostler members, the General Chairman has found it necessary, while using the firemen's Schedule as a basis, to quote both wherever any of the engineers' Schedule Rules differ front the firemen's rules. Where only one regulation is quoted, it should be understood that the language of the engineers' corresponding regulation is the same.
In presenting this hook, the General Chairman sincerely hopes that it will be of material assistance to all our members in assisting them to decide the compensation to which they are entitled for services performed, and to assist our Local Chairman in handling with the Superintendents the grievances of our members.
