In May 1951, the Association of Interstate Commerce Commission Practitioners published a list of 256 United States Supreme Court decisions, among which were 172 decisions important to the Interstate Commerce Commission, including the 100 then most frequently cited by the Commission, as compiled
in 1939 by Harold D. McCoy, Assistant Chief Examiner, and E. M. Reidy, Chief Counsel, of the I.C.C. Also included, as well as abstracted, were 39 important decisions since 1939. After the publication of that list, several members suggested that all of the cases included therein be abstracted and published.
This book contains abstracts of those 256 decisions and 30 other cases deemed of interest which were decided since the previous compilation was made. Insofar as possible, the abstracts have been arranged in accordance with the section of the Interstate Commerce Act to which the main point of decision is related. In many instances where two or more important points were decided in one case, the case is completely abstracted under the section covering what is considered the main point and short excerpts are included under other sections pertaining to subsidiary questions decided. Space limitations have necessarily confined such cross references to a minimum.
Above the title of each case are the topics with which it deals and immediately following the name and citation is a short "Conclusion," briefly summarizing the main point or points decided. The "Facts" in each case are stated
II fairly completely to aid in understanding the situation as to which the rulings were made. The "Issues" are separately stated and numbered to show exactly what questions were presented and decided. The "Rulings" are generally confined to holdings on the points set out as "Issues." Rulings on points considered comparatively unimportant or not connected with matters within the jurisdiction of the Interstate Commerce Commission have usually been omitted.
The style of citation generally follows that in "Interstate Commerce Acts, Annotated."
The abstracts and arrangement of cases are the work of Walter J. Myskowski, an Examiner at the Interstate Commerce Commission.
