INTRODUCTION
This book is designed for use either as collateral reading in connection with a text of the orthodox type or as a text for studying by the case method the subject of the governmental regulation of the railroads. This method is at its best in the study of governmental operations. The student approaches the subject through the original sources and builds up his knowledge inductively from first-hand observation. He reads for himself the statutory provisions which deal with a particular situation and, by analysis, meditation, and simplification, builds up his conception of their meaning. In his hands are placed administrative reports which summarize the operations directed by the statutes, and which give him a measure of their effectiveness. He distills administrative decisions and finds the statutes more meaningful as the process of application goes on before his eyes. He wrestles with court opinions which settle beyond argument the construction to be given to the words of the legislature. Thus, instead of being dependent upon an intermediate expositor, he comes face to face with the actual records, the governmental action itself, much as the modern student of the natural sciences views the phenomena in which he is interested.
It is evident that the differences in form, content, and purpose between a collection of selected source material of this character and the orthodox didactic text will necessitate a different technique of study ; hence a few suggestions as to the method of preparing assignments may be helpful.
